Overall Agreement

Acceptance of the Terms of Service

Welcome to eyeDactic! (a.k.a. “we” or “us” or the “Company”). We are excited to have you as a user. The following terms and conditions (together with any documents referred to in them) (collectively, these “Terms of Service”) apply to your use of the eyeDactic system (the “System”), which collectively includes any content, functionality and services offered on or through eyeDactic.com (the “Website”), the eyeDactic applications (the “Applications”) and the eyeDactic services (the “Services”).

These Terms of Service incorporate this Overall Agreement and additional agreements included in this document, namely; the Terms of Service for the eyeDactic Website and Services, the End User Licensing Agreement for the eyeDactic Applications, and the eyeDactic Privacy Policy.

We want to keep our relationship with you as lean and informal as possible, but please read the Terms of Service carefully before you start to use the eyeDactic system. By using the System, or any of its Website, Applications, or Services, you accept and agree to be bound and abide by these Terms of Service.

Should you disagree with some of the provisions of the overall Terms of Service, you can leave the Website, stop using the Applications and Services, stop using the System, or contact us at support@eyeDactic.com.

Changes to the Terms of Service

eyeDactic is a work in progress, and we will update these Terms of Service from time to time in our sole discretion. Since these documents are public on eyeDactic.com, you will be able to track all changes between versions. Your continued use of the System, including Website, Applications, and Services, following the publishing of revised Terms of Service means that you accept and agree to the changes.

Accessing the System and Account Security

eyeDactic is in an early stage version, meaning you can only access it with a login account that we provide you, and meaning that a lot will change in the near future. We reserve the right to withdraw or amend, even dramatically, the System, including Website, Applications, and Services, in our sole discretion without notice. Also, we will not be liable if for any reason all or any part of the System is unavailable at any time or for any period. As said, this is an early version and incorporating new features might impact the reliability of the System. From time to time, we may restrict access to some parts of the Website, or the entire Website, to users, including registered users.

To access the System you are provided with a secure user name, password or any other piece of information as part of our security procedures. You must treat such information as confidential, and you must not disclose it to any third party. You agree to immediately notify Company of any unauthorized use of your user name or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each web session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

In the future, you may be asked to provide certain registration details or other information. It is a condition of your use of the System that all the information you provide to the System is correct, current and complete.

We have the right to disable any user identification code or password, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including, if in our opinion, you have failed to comply with any provision of these Terms of Service.

“This is not an NDA” clause

You are allowed to publicly talk and write about the eyeDactic System and the Website, albeit acknowledging that the System and the Website are in an early stage and everything is subject to change. For this reason, we kindly ask you to restrain of publishing full reviews, public tests, screenshots or anything else that might unfaithfully represent eyeDactic. We trust your judgment and discretion in helping us develop and improve eyeDactic!

Disclaimer of Warranties, Limitations of Liability and Indemnification.

You acknowledge that you have only a limited, non-exclusive, nontransferable license to use the System. You agree that you will use it carefully and avoid using it ways, which might result in any loss of your or any third party’s property or information.

Your use of the eyeDactic System is at your sole risk. The Services are provided on an “as is” and “as available” basis. In particular, you acknowledge that technical support is only provided in only available via email, in English; that we use third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the System; that the technical processing and transmission of the service, including User Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

We do not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the service will be corrected.

You expressly understand and agree that eyeDactic shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if eyeDactic has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.

You agree to defend, indemnify and hold harmless the Company, its affiliates and licensors and their respective officers, directors, employees, contractors, agents, licensors and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) resulting from your violation of these Terms of Use or your use of the System, including, without limitation, any use of the Website’s content, services and products other than as expressly authorized in these Terms of Use or your use of any information obtained from the Website or System.

Geographic Restrictions

eyeDactic is based in the state of California in the United States. We provide this System for use only by persons located in the United States. We make no claims that the System or any of its content is accessible or appropriate outside of the United States. Access to the System may not be legal by certain persons or in certain countries. If you access the System or Website from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of, or related to, them, their subject matter or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action or proceeding arising out of, or related to, these Terms of Service or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of California. You waive any and all objections to the exercise of jurisdiction over you other courts and to venue in such courts.

Waiver and Severability

Our failure to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision.

The Terms of Service constitutes the entire agreement between you and eyeDactic and govern your use of the service, superseding any prior agreements (including, but not limited to, any prior versions of the Terms of Service). If any provision of these Terms of Service is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.

Terms of Service for the eyeDactic Website and Services

Intellectual Property Rights

The Website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by the Company, its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

You are permitted to use the Website and Services for purpose not inconsistent with applicable law or these Terms of Use.

Prohibited Uses

You may use the Website and Services only for lawful purposes and in accordance with these Terms of Service. You agree not to use the Website and Services:

  • In any way that violates any applicable federal, state, local and international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
  • To send, upload, download, use or re-use any material that does not comply with the Content Standards set below.
  • To transmit, or procure the sending of, any mass advertising or direct solicitation material.
  • To impersonate or attempt to impersonate the Company or a Company employee, another user, or another person or entity (including, without limitation, the use of e-mail addresses or screen names associated with or confusingly similar to any of the foregoing).
  • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Website, or which, as determined by us, may harm the Company or users of the Website or expose them to liability.

Additionally, you agree not to:

  • Use the Website in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Website, including their ability to engage in real time activities through the Website.
  • Use any robot, spider or other automatic device, process or means to access the Website for any purpose, including monitoring or copying any of the material on the Website.
  • Use any manual process to monitor or copy any of the material on the Website or for any other unauthorized purpose without our prior written consent.
  • Use any device, software or routine that interferes with the proper working of the Website.
  • Introduce any viruses, Trojan horses, worms, logic bombs or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer or database connected to the Website.
  • Attack the Website via a denial-of-service attack or a distributed denial-of-service attack or otherwise attempt to interfere with the proper working of the Website.

User Contributions and Legal Disclaimer

The Website contain user generated content, and also may contain message boards, personal web pages or profiles, forums or other interactive features (collectively, “Interactive Services”) that allow you to post, submit, publish, display or transmit to other users (hereinafter, “post”) content or materials (collectively, “User Content”) on or through the Website.

All User Content must comply with the Content Standards set out below.

We claim no intellectual property rights over the User Content. Your profile and materials uploaded remain yours. However, by submitting the User Content, you agree to allow others to view, comment, edit and branch your User Content, and you grant us the right to use, copy, distribute and disclose to third parties any such material for any purpose. You represent and warrant that you own or control all rights in and to the User Content and have the right to grant the Company and its affiliates the license granted above. You represent and warrant that all of your User Content does and will comply with these Terms of Service, and you agree to defend, indemnify and hold harmless the Company and its affiliates and licensors for any breach of that representation and warranty.

Any feedback, comments, or suggestions you may provide regarding eyeDactic is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.

You understand and acknowledge that you are responsible for any User Content you submit or contribute, and you, not the Company, have full responsibility for such content, including its legality, reliability, accuracy and appropriateness. Any content and/or opinions uploaded, expressed or submitted to the Website, and all articles and responses to questions and other content, other than the content provided by the Company, are solely the opinions and the responsibility of the person or entity submitting them and do not necessarily reflect the opinion of the Company. We are not responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the Website.

In particular, User Content is not intended to be legal advice or form an attorney-client relationship between the users, or between the users and the Company. Use of the Website should never be understood to be replacing use of a qualified attorney, and eyeDactic’s relationship to all documents and transactions completed using the Website is that of a trusted, disinterested technology platform.

Monitoring and Enforcement of User Content; Termination

We have the right to:

  • Remove or refuse to post any User Content for any or no reason in our sole discretion.
  • Take any action with respect to any User Content that we deem necessary or appropriate in our sole discretion if we believe that such User Content violates the Terms of Service, including the Content Standards, infringes any intellectual property right or other right, threatens the personal safety of users of the Website and the public or could create liability for the Company.
  • Disclose user identities when required to do so by applicable alw, including in response to a law enforcement request supported by a valid court order.
  • Terminate your access to all or part of the Website for any or no reason, including without limitation, any violation of these Terms of Service.

You waive and hold harmless the Company from any claims resulting from any action taken by the Company during or as a result of its investigations and from any actions taken as a consequence of investigations by either the Company or law enforcement authorities.

We do not undertake to review all material before it is posted on the Website, and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any action or inaction regarding transmissions, communications or content provided by any user or third party. We have no liability or responsibility to anyone for performance or nonperformance of the activities described in this paragraph.

Content Standards

These content standards apply to any and all User Content and Interactive Services. User Content must comply with all applicable federal, state, local and international laws and regulations. Without limiting the foregoing, User Content must not:

  • Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable.
  • Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • Infringe any patent, trademark, trade secret, copyright or other intellectual property rights of any other person.
  • Violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Service.
  • Be likely to deceive any person.
  • Promote any illegal activity, or advocate, promote or assist any unlawful act.
  • Cause annoyance, inconvenience or needless anxiety or be likely to upset, embarrass, alarm or annoy any other person.
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person or organization.
  • Involve commercial activities or sales , such as contests, sweepstakes and other sales promotions, barter or advertising.
  • Give the impression that they emanate from us or any other person or entity, if this is not the case.

Copyright Infringement

If you believe that any User Content violate your copyright, please email us at support@eyeDactic.com for instructions on sending us a notice of copyright infringement. It is the policy of the Company to terminate the user accounts of repeat infringers, and we are in the process of setting up a DMCA compliant process for managing cases of infringement.

Reliance on Information Posted

The information presented on or through the Website is made available solely for general information purposes. We do not warrant the accuracy, completeness or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Website, or by anyone who may be informed of any of its contents.



End User Licensing Agreement for eyeDactic Applications

This agreement (or “EULA”) is a legal agreement between the person, company or organization (“You”) that has licensed a software product (“Product”) and eyeDactic (“Licensor” or “Application Provider”). The mobile version of the Product is to be obtained only through Apple’s software distribution platform (“AppStore”) and through Google’s software distribution platform (“Google Play Store”). The laptop and desktop version of the Product is to be obtained only through the eyeDactic website. The “AppStore” and “Google Play Store” are referred to in this license as “Services”. By installing and/or using any Product provided by the Licensor, You are confirming your acceptance of this agreement and you are agreeing to become bound by the terms of this agreement.

This EULA shall apply only to a Product supplied by the Licensor herewith regardless of whether other software or platform is referred to or described herein.

The Products transacted through the Services are licensed, not sold, to You for use only under the terms of this license. The Application Provider reserves all rights not expressly granted to You. The Product that is subject to this license is referred to in this license as the “Licensed Application.” The Licensed Application is to be used on devices and/or computers that operate with Apple’s device operating systems (“iOS”) and/or with Google’s device operating system (“Android”) and/or with the Macintosh computer operating system and/or with the Windows computer operating system and the aforementioned devices and computers are referenced in this license collectively as “Devices”. The App Store Terms and Conditions and the Google Play Terms of Service are referenced in this license as “Usage Rules”.

a. Scope of License: This license granted to You for the Licensed Application by Application Provider is limited to a non-transferable license to use the Licensed Application on any Devices that You own or control and as permitted by the Usage Rules. This license does not allow You to use the Licensed Application on any Devices that You do not own or control, and You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute or sublicense the Licensed Application. You may not copy (except as expressly permitted by this license and the Usage Rules), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open sourced components included with the Licensed Application). Any attempt to do so is a violation of the rights of the Application Provider and its licensors. If You breach this restriction, You may be subject to prosecution and damages. The terms of the license will govern any upgrades provided by Application Provider that replace and/or supplement the original Product, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.

b. Consent to Use of Data: You agree that Application Provider may collect and use technical data and related information, including but not limited to technical information about Your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to You (if any) related to the Licensed Application. Application Provider may use this information, as long as it is in a form that does not personally identify You, to improve its products or to provide services or technologies to You. You also agree the Licensed Application may broadly collect information from the Device, including personally identifiable information, in support of the eyeDactic Services related to managing and monitoring the Device running the Licensed Application. The data collected on the Device may include, but is not limited to; applications usage information, web browsing information, GPS and other location information, media upload and download information, and messaging information. Please refer to the eyeDactic Privacy Policy for more information on how this data is used and shared.

c. Termination. The license is effective until terminated by You or Application Provider. Your rights under this license will terminate automatically without notice from the Application Provider if You fail to comply with any term(s) of this license. Upon termination of the license, You shall cease all use of the Licensed Application, and destroy all copies, full or partial, of the Licensed Application.

d. Services; Third Party Materials. The Licensed Application may enable access to Application Provider’s and third party services and web sites (collectively and individually, “Services”). Use of the Services may require Internet access and that You accept additional terms of service.

You understand that by using any of the Services, You may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language, and that the results of any search or entering of a particular URL may automatically and unintentionally generate links or references to objectionable material. Nevertheless, You agree to use the Services at Your sole risk and that the Application Provider shall not have any liability to You for content that may be found to be offensive, indecent, or objectionable.

Certain Services may display, include or make available content, data, information, applications or materials from third parties (“Third Party Materials”) or provide links to certain third party web sites. By using the Services, You acknowledge and agree that the Application Provider is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such Third Party Materials or web sites. The Application Provider does not warrant or endorse and does not assume and will not have any liability or responsibility to You or any other person for any third-party Services, Third Party Materials or web sites, or for any other materials, products, or services of third parties. Third Party Materials and links to other web sites are provided solely as a convenience to You. Financial information displayed by any Services is for general informational purposes only and is not intended to be relied upon as investment advice. Before executing any securities transaction based upon information obtained through the Services, You should consult with a financial professional. Location data provided by any Services is for basic navigational purposes only and is not intended to be relied upon in situations where precise location information is needed or where erroneous, inaccurate or incomplete location data may lead to death, personal injury, property or environmental damage. Neither the Application Provider, nor any of its content providers, guarantees the availability, accuracy, completeness, reliability, or timeliness of stock information or location data displayed by any Services.

You agree that any Services contain proprietary content, information and material that is protected by applicable intellectual property and other laws, including but not limited to copyright, and that You will not use such proprietary content, information or materials in any way whatsoever except for permitted use of the Services. No portion of the Services may be reproduced in any form or by any means. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services, in any manner, and You shall not exploit the Services in any unauthorized way whatsoever, including but not limited to, by trespass or burdening network capacity. You further agree not to use the Services in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party, and that the Application Provider is not in any way responsible for any such use by You, nor for any harassing, threatening, defamatory, offensive or illegal messages or transmissions that You may receive as a result of using any of the Services.

In addition, third party Services and Third Party Materials that may be accessed from, displayed on or linked to from the Devices are not available in all languages or in all countries. The Application Provider makes no representation that such Services and Materials are appropriate or available for use in any particular location. To the extent You choose to access such Services or Materials, You do so at Your own initiative and are responsible for compliance with any applicable laws, including but not limited to applicable local laws. The Application Provider, and its licensors, reserve the right to change, suspend, remove, or disable access to any Services at any time without notice. In no event will the Application Provider be liable for the removal of or disabling of access to any such Services. The Application Provider may also impose limits on the use of or access to certain Services, in any case and without notice or liability.

e. No Warranty: You expressly acknowledge and agree that use of the licensed application is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you. To the maximum extent permitted by applicable law, the license application and any services performed or provided by the licensed application (“services”) are provided “as is” and “as available,” with all faults and without warranty of any kind, and application provider hereby disclaims all warranties and conditions with respect to the licensed application and any services, either express, implied or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, and non-infringement of third party rights. Application provider does not warrant against interference with your enjoyment of the licensed application, that the functions contained in, or services performed or provided by, the licensed application will meet your requirements, that the operation of the licensed application or services will be uninterrupted or error-free, or that effects in the licensed application or services will be corrected. No oral or written information or advice given by application provider or its authorized representative shall create a warranty. Should the licensed application or services prove defective, you assume the entire cost of all necessary servicing, repair or correction. Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so the above exclusion and limitations may not apply to you.

f. Limitation of Liability. To the extent not prohibited by law, in no event shall application provider be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use the licensed application, however caused, regardless of the theory of liability (contract, tort or otherwise) and even if application provider has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of liabilty for personal injury, or of incidental or consequential damages, so this limitation may not apply to you.

In no event shall Application Provider’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of the minimum of fifty dollars ($50.00) or the amount paid by You for subscription and paid eyeDactic Services for the last month in which you subscribed to those Services. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

g. You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. In particular, but without limitation, the Licensed Application may not be exported or re-exported (a) into any U.S. embargoed countries or (b) to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person’s List or Entity List. By using the Licensed Application, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture or production of nuclear, missiles, or chemical or biological weapons.

h. The Licensed Application and related documentation are “Commercial Items”, as that term is defined at 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation”, as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. Unpublished-rights reserved under the copyright laws of the United States.

i. The laws of the State of California, excluding its conflicts of law rules, govern this license and your use of the Licensed Application. Your use of the Licensed Application may also be subject to other local, state, national, or international laws.



eyeDactic Privacy Policy


This Privacy Policy governs the manner in which eyeDactic collects, uses, maintains and discloses information collected from users (each, a “User“) of the www.eyedactic.com website and all devices and computers that are managed by a User and monitored by the eyeDactic service (each, a “Device”). This privacy policy applies to the eyeDactic web site (“Site”), eyeDactic applications (“Applications”), and all products and services (“Services”) offered by eyeDactic. This privacy policy covers four types of information:

  1. Device Information – information from the devices that are managed by Users and are monitored by the eyeDactic applications and services
  2. User Information, consisting of:
    1. Personally Identifiable Information – information from and about the User that could be used to personally identify the User
    2. Non-personally Identifiable Information – information from and about the User that could not be used individually to personally identify the User
  3. User Content – information added by Users in the course of community activities and interaction

General Information Sharing Policy

We do not share Device Information with anyone other than the User who is managing the Device, unless required to do so by law. We may freely share generic aggregated Device Information, not linked to any specific User or monitored Device.

We do not share User Information with anyone other than the User it relates to, unless required by law. We may freely share generic aggregated User Information, not linked to any specific User.

We may share User Content freely, as explained by the license you grant to eyeDactic for User Content in the eyeDactic Terms and Conditions.

Device information

How is Device Information collected?

We collect extensive and detailed information from managed devices, including, but not limited to, applications usage information, web browsing information, downloading and uploading information, configuration information related to the device, email and messaging information, and GPS and other physical location information. With the permission of the User who is managing the Device, we may access other personal information on the Device, including contacts, calendar and messaging information. This information may come from other applications running on the device.

How we use Device Information


eyeDactic may collect and use Device Information for the following purposes:


  • To accumulate, store, and provide both specific and aggregated Device Information to the User who is the manager of the Device.
  • To manage the data collection and other application functionality on the Device.

We do not sell, trade, or rent Device information to anyone other than the User who is managing the Device. We may freely share generic aggregated device information not linked to any specific User or specific monitored device.

User Content

How we collect User Content

We collect User Content when a User participates in community activities on the web site, including posting in community forums, and voting on or rating items. By agreeing to participate in community activities on the Site, the User agrees that eyeDactic is granted a broad license to use the User Content they enter and may share this information freely.

User Content is anonymous to the extent that the User chooses to keep it so. Users should be aware that others, not necessarily registered users of the Site, might see User Content. Registered users of the Site are also under no legal obligation to keep anything they see in the community sections of the Site confidential, so Users should be careful not to post information in these sections that they consider personally identifiable or confidential.

  • To provide information to other Users about items reported during monitoring, such as applications and web sites and pages visited on monitored devices
  • To provide a community forum for discussion among Users
  • To inform Users of school events, monitoring trends, and other information
  • To provide a channel of communication between parents and school administrators

We may share User Content with anyone. The primary method of sharing is with other Users, when they are registered and logged into the Site, and with school administrators and other school members. However, there is no guarantee that sharing will be restricted to registered users or members of the Site or that other Users will not make the information public.

Personally Identifiable Information

We may collect personally identifiable information from Users in a variety of ways, including, but not limited to, when Users visit our web site, register on the Site, place an order, respond to a survey, fill out a form, and in connection with other activities, services, features or resources we make available on the Site. Users may be asked for, as appropriate, name, email address, and credit card information. Users may, however, visit the Site anonymously. We will collect personally identifiable information from Users only if they voluntarily submit such information to us. Users, when installing or configuration eyeDactic applications and services on a Device, may also be asked for, as appropriate, name, email address and other Personally Identifiable Information.

We may collect non-personally identifiable information from Users whenever they interact with our web site. Non-personally identifiable information may include the User’s browser name, the type of computer and technical information about User’s means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

The Site may use “cookies” to enhance the User experience. Cookies may result in the collection of both Personally Identifiable and Non-personally Identifiable information. The User’s web browser may store and access cookies on their hard drive for record-keeping purposes and sometimes to track information about them. We only use web site cookies to maintain and customize the web browsing and eyeDactic system experience. We do not use web site cookies for advertising tracking purposes, and we do not provide cookie data to third-party advertisers or any other external party.

We do not sell, trade, or rent User Information to others. We may share generic aggregated information not linked to any specific User with others.

California residents are legally entitled (at no charge and no more than once annually) to request information about how we may have shared your information with others for direct marketing purposes. Registered Users may request this information using the eyeDactic web site.

No ad companies collect data through our service. We do not allow advertising companies to collect data through our service for ad targeting.

You can ask privacy questions or opt-out of any eyeDactic marketing activities. These options are available on the web site to registered Users.

Compliance with Children’s Online Privacy Protection Act


Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our Site from those we actually know are under 13, and no part of our website is structured to attract anyone under 13.

How we protect your information


We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

Lifetime of information

We keep personal identification data until the User explicitly deletes it (when that option is available) or until the User deletes his/her account with eyeDactic.

We remove personally identifiable information (such as User name, address, email or phone number) and other preferences associated with the User account promptly after the User deletes his/her account. We may retain community activity data that the User entered indefinitely. This can include, but is not limited to forum posts, votes and ratings on monitored items.

Special situations may require disclosure of your data.

To operate the service, we also may make identifiable and anonymous User and Device information available to third parties in these limited circumstances: (1) with your express consent, (2) when we have a good faith belief it is required by law or (3) to any successor or purchaser in a merger, acquisition, liquidation, dissolution or sale of assets, provided that a User may elect to remove all User Information and Device Information by cancelling his/her account on the event of such a change in eyeDactic company status. User consent will not be required for disclosure in these cases, but we will attempt to notify the User, to the extent permitted by law to do so.

Changes to this privacy policy


eyeDactic has the discretion to update this privacy policy at any time. When we do, we will post a notification on the main page of our Site, revise the updated date at the bottom of this page and send you an email. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.
